I am trying to make a permanent cloak that activate when out of combat.
I am trying to use validators for this, the one checking if the unit takes damage and I wanted the cloak to reactivate i the unit was out of combat for three seconds.
It won't work however, I added it to my ability, could my ability be set up wrong?
For permanent cloaks just use a validated buff behaviour. You could always do the inverse logic of a buff that disables cloaking when active or a buff that adds cloaking when active. The second option is more simple.

I tried to create similar ability in the past using data, but ended up with headache.
But odd enough can easily be done using triggers.

So using a buff with the Caster Not In Combat validator is not working?

Can I use this method on a unit tjat uses the cloak flag. Then just use a buff as you say with the validator?

I was gonna suggest taking a look at the mutalisk out of combat healing buff, but sounds like you got it solved.
