Hey, it is not fpx but fbx, which is standard in Max. So that should not be a problem.
Now it looks like a model that has been ripped from LotR and therefor it is not legal to use it since it is under the copyright of the creators of the game.
I think you better check out from where it came, and raise the possibility to use it with Blizzard's legal department.

Are we allowed to use that model? Can we even use it? (It's .fpx not .3ds and I'm not sure if it's possible to convert fpx to 3ds(new to this)...)
